Acceptance
By downloading, accessing, or using RefScale, you agree to these Terms of Use and to Apple’s applicable App Store terms. If you do not agree, do not use RefScale.
The Service
RefScale provides photo-based measurement tools and optional AI-powered image processing features. Measurements are estimates based on the selected reference object, image perspective, image quality, and user input. RefScale is not a professional measuring instrument and should not be used for medical, legal, construction, engineering, safety-critical, or other high-risk decisions.
Measurement Accuracy
RefScale measurements are approximate. Accuracy depends on factors including the selected reference object, how precisely you place the reference and measurement markers, camera angle, lens distortion, perspective, image quality, object curvature, and whether the reference object and measured object are on the same physical plane and at the same distance from the camera.
Perspective can make objects appear larger or smaller when they are closer to or farther from the camera than the reference object. For best results, place the reference object next to the object being measured, keep both objects flat on the same surface when possible, keep the camera as perpendicular to that surface as possible, and avoid wide-angle distortion. RefScale does not provide certified, construction-grade, engineering-grade, medical, legal, or safety-critical measurements.
Accounts
You may use RefScale without registering or signing in. RefScale uses a device-backed session to provide measurements, subscriptions, credit purchases, restore, and entitlements. You are responsible for maintaining the security of your device and app session. You can delete your account or guest data in the app from Profile > Account & Data, or contact [email protected] for help.
When you delete your account or guest data, RefScale deletes or de-identifies account profile data, clears active sessions and push notification devices, deletes AI job history and generated AI content associated with the account, and removes local measurement data from that device. RefScale may retain records that are required or reasonably necessary for billing, subscription verification, credit accounting, free-allowance measurement counts, security, abuse prevention, diagnostics, legal compliance, accounting, dispute handling, and deletion audits.
Subscriptions and Credits
- RefScale Pro is an auto-renewable subscription billed monthly or yearly through the Apple App Store. The available plans, prices, duration, and included benefits are shown before purchase and may vary by country or region.
- Pro provides ongoing app access such as unlimited measurements and the subscription AI credit allowance shown in the app at the time of purchase. Subscription AI credits reset each subscription period and have no cash value.
- Your Apple Account is charged when you confirm purchase. A subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple Account subscription settings.
- Deleting your RefScale account does not cancel your App Store subscription. App Store subscriptions are managed by Apple and may continue unless you cancel them through Apple subscription settings.
- AI credit packs are consumable in-app purchases. Purchased credits are added after Apple verifies the transaction, are non-transferable, have no cash value, and do not expire while your account remains active.
- Credits are charged when an AI job is submitted. If a charged AI job fails in a way RefScale can verify, credits may be refunded automatically to your RefScale credit balance.
- Refunds for App Store purchases are handled by Apple according to Apple’s policies. RefScale cannot issue App Store refunds directly.
- Restore Subscription asks Apple for your current subscription entitlements and re-verifies eligible active subscriptions for the current RefScale device session. Consumable AI credit packs are not restored by Apple’s current entitlement APIs.
User Content
You retain ownership of photos, masks, prompts, measurement data, and AI results you provide or create through RefScale. You grant RefScale a limited license to host, process, transmit, display, and store that content only as needed to provide the service, process AI jobs, maintain your account, troubleshoot issues, and comply with law. You are responsible for having the rights and permissions needed for any content you upload or process.
Acceptable Use
You agree not to misuse RefScale or use it to process content that:
- Violates any applicable law or regulation.
- Infringes or violates another person’s intellectual property, privacy, publicity, or other rights.
- Is abusive, exploitative, deceptive, hateful, sexually explicit, or otherwise prohibited by our AI providers’ policies.
- Attempts to bypass purchase, credit, security, rate-limit, or entitlement systems.
- Interferes with RefScale’s servers, reverse engineers the service, or uses automated access without permission.
AI Features
AI-generated or edited results are probabilistic outputs and predictions based on your input image, mask, prompt, and the AI provider’s model. They may be approximate, inaccurate, incomplete, unexpected, visually inconsistent, or different from what you wanted. RefScale does not guarantee that AI results will preserve real-world dimensions, match the original scene, remove or extend content perfectly, or be suitable for any particular purpose. You are responsible for reviewing AI results before relying on, sharing, or using them. We may reject, block, or fail AI jobs that violate these Terms, provider policies, safety rules, technical limits, or applicable law.
Intellectual Property
RefScale, including its app, design, software, branding, and non-user content, is owned by the developer and protected by intellectual property laws. These Terms do not grant you ownership of RefScale or any right to use RefScale branding except as allowed by law.
Privacy
Our Privacy Policy explains what data RefScale collects, how it is used, how AI image processing and diagnostic reporting work, how data is retained, and how to request deletion.
App Store Terms
If you download RefScale from the Apple App Store, your purchase and use of App Store services are also subject to Apple’s applicable terms, including Apple Media Services terms and App Store subscription management rules. Apple is not responsible for RefScale’s support, content, or warranties beyond any obligations Apple has under applicable law.
Disclaimer
RefScale is provided “as is” and “as available” without warranties of any kind to the maximum extent permitted by law. We do not guarantee that measurements, AI results, subscriptions, credits, or app availability will be uninterrupted, error-free, or fit for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, RefScale and its developer are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from inaccurate measurements, AI results, user content, service interruptions, or your use of the app.
Termination
We may suspend or terminate access to RefScale if you violate these Terms, abuse the service, create security or legal risk, or if we discontinue the service. You may stop using RefScale at any time, and you may delete your account or guest data in the app.
Changes
We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the new terms.
